Welcome to the Online Owner Rental Listings

There are 3 forms that must be submitted in order to list your unit for Rental. The Consumer Notice and the Listing Agreement can be filled out online. The W9 Form must be printed out, completed and mailed to:

We will list your unit for rental once we have received the online forms, but you must mail the W9 Form within 2 weeks or we will cancel your listing.

Exclusive Listing Agreement
Terms and Conditions:

1.  BROKER’S RIGHTS - You hereby grant Shawnee Realty, Inc. (“Broker”) the irrevocable right to lease your property for a minimum of two nights to six nights at rates established by Broker. In the event of an emergency, The Broker has the right to lease your property for one night at its sole discretion. The Broker has the right to discount any established rental rates from 10% up to and including 25% at any time of the year in its sole discretion.

2.  TERM - This Agreement shall remain in effect for the length of time specified in the "Term" field of the online listing form (Maximum one year or through one interval).

3.  COMMISSION - Except as outlined in Paragraph 4, if the property is rented during the term of this Agreement by You, Broker or any other person, You agree to pay Broker a commission of 33% of the gross rental amount.  BROKER EARNS ITS COMMISSION REGARDLESS OF WHO ARRANGES THE RENTAL.

4.  NOTICE NECESSARY FOR YOU TO USE YOUR INTERVAL: YOUR USE IS SUBJECT TO THIS LISTING AGREEMENT - Your Interval is at all times subject to Broker’s right to lease the unit and any prior rental commitments made by Broker. It is your responsibility to contact Broker in writing (e-mail or fax acceptable) for all information regarding the status of your Unit. During the two weeks prior to the beginning of the Interval, at the option of the Broker, our Interval may be released to You for your use. If the Interval is released to You as provided in this paragraph, You must notify Broker in writing (e-mail or fax acceptable) of your intention to rent, occupy or exchange the property and you may not proceed without written approval from Broker. You will not be responsible for any commission of lost rental to Broker if you rent a released Interval in accordance with this paragraph.

5.  UNPAID ASSESSMENTS - Any unpaid annual assessments, delinquent installments, unpaid bills or other fees owed to Interval Management, Inc. or Shawnee Development, Inc. shall be deducted from the net proceeds due You and remitted as appropriate by Broker.

6.  HOUSEKEEPING AND OTHER CHARGES - If the Unit is rented to more than one party during the Interval, Interval Management, Inc will impose a housekeeping charge.  It is agreed that said charge is to be deducted from the gross rental proceeds.  If the Unit is rented, and prior to orafter the rental You occupy the Unit, You will be responsible for the $65 housekeeping charge.  Additional charges may be assessed for extensive, unusual cleaning and/or repairs required when the Unit is first occupied by You and not returned in reasonable condition.  Said additional charges will also be deducted according to the provisions of this paragraph.

7.  PAYMENT OF YOUR RENTAL PROCEEDS - Broker shall pay You the net rental proceeds, if any, on or about the 18th of the next month following the Interval (e.g., if we rent your Unit in January, your rental proceeds will be sent on or about February 18th).

8.  DEFAULT BY RENTER. - In case of any default by a renter, Broker shall keep any deposits made by the renter in lieu of its commission.  In no case, however, will Broker retain more than 33% of the agreed-upon gross rental amount; any monies received by Broker in excess of this amount shall be remitted to You.

9.  ESCROW. - All payments on account of transactions arising out of this Agreement shall be retained in escrow in accordance with the real estate licensing laws of the Commonwealth of Pennsylvania.

10. YOUR REPRESENTATIONS - You represent that You have the right to enter into this Agreement and have not submitted the Intervals to any exchange network for trading purposes or to any other broker for rental or resale.  If any Interval is not available for rental as set forth above, You will be liable for losses or damages incurred by Broker.  If the property has been previously listed with another Broker, You may be liable for two commissions.

11. BROKER NOT LIABLE FOR DAMAGES CAUSED BY RENTERS - Broker hereby disclaims any and all liability for damage to the Unit caused by renters.

12. RECOVERY FUND - Pennsylvania has a Real Estate Recovery Fund (the “Fund”) to repay any person who has received a final court ruling (civil judgment) against a Pennsylvania real estate licensee because of fraud, misrepresentation, or deceit in a real estate transaction.  The Fund repays persons who have not been able to collect the judgment after trying all lawful ways to do so. 13. NOTICE TO PERSONS OFFERING TO SELL OR RENT HOUSING IN PENNSYLVAINA - Federal and state laws make it illegal for You, Broker, or anyone to use RACE, COLOR, RELIGION or RELIGIOUS CREED, SEX, DISABILITY (physical or mental), FAMILIAL STATUS (children under 18 years of age), AGE (40 or older), NATIONAL ORIGIN, USE OR HANDLING/TRAINING OF SUPPORT OR GUIDE ANIMALS, or the FACT OR RELATIONSHIP OR ASSOCIATION TO AN INDIVIDUAL KNOWN TO HAVE A DISABILITY as reasons for refusing to sell, show, or rent properties, loan money, or set deposit amounts, or as reasons for any decision relating to the sale of property.

14. ENTIRE AGREEMENT - This instrument contains the entire Agreement between the parties and shall be binding upon their heirs, executors, successors and assigns.  No modification of this Agreement shall be valid or binding unless set forth in writing, dated and signed by all parties.
